I\/We, the undersigned (as designated on page 1), personally and as properly authorised agents of the Customer, in consideration of Davey granting credit to the Customer, jointly and severally:<\/p>\n

    \n
  1. Agree that this instrument is given as collateral security to the Davey Terms and Conditions of Sale and any other security for or on behalf of the Customer.<\/li>\n
  2. Agree to pay not later than 30 days after the end of the month of<\/li>\n
  3. Do hereby jointly and severally guarantee payment of all amounts due to Davey by the<\/li>\n
  4. Agree that the Customer shall be liable for all costs, charges, commissions, fees and disbursements incurred by Davey in the recovery of any unpaid account including charges for any dishonoured cheques received.<\/li>\n
  5. Agree that credit facilities may be withdrawn at any time without prior<\/li>\n
  6. Agree that any change to any of the trading particulars detailed in this application shall be notified to Davey within seven days of such change and is subject to acceptance by Davey and that acceptance of any subsequent payment does not constitute acceptance of any change of any of the particulars.<\/li>\n
  7. Agree that:\n
      \n
    • All payments shall be made to the Head Office of Davey in Victoria; and<\/li>\n
    • These Terms and Conditions and any agreements entered into pursuant to any collateral security are governed by and must be construed in accordance with the laws of Victoria and the guarantor hereby agrees to submit to the exclusive jurisdiction of the courts of Victoria.<\/li>\n<\/ul>\n<\/li>\n
    • If Davey considers it relevant in respect of commercial credit provided to me\/us, the Guarantors, any of them or the Customer, I\/ We agree, for the purposes of the Privacy Act 1988 (Cth)(as amended), to Davey receiving from any credit reporting body named in this application credit eligibility information the following information for the purpose of the provision of commercial credit to me\/ us in connection with this application for credit:\n
        \n
      • Information relating to my\/our\/the Customer\u2019s commercial activities or commercial credit worthiness;<\/li>\n
      • A commercial credit report; and\/or<\/li>\n
      • personal information about me\/us to assess whether to accept me\/us as a borrower or guarantor for commercial<\/li>\n<\/ul>\n<\/li>\n<\/ol>\n

        credit (excluding consumer credit information) receive from any credit reporting body or any financial institution or credit provider whose name appears in any commercial credit report supplied to Davey or whose name is given to Davey by me\/us\/the Customer.<\/p>\n

        Currently Davey obtains commercial credit reports from Dunn & Bradstreet although it may source from other credit reporting bodies.<\/p>\n

          \n
        1. I\/We agree that Davey may give or disclose to, any credit provider,named in this credit application or who I\/we nominate and any person or body agreeing or considering whether to agree to be liable for any credit to be made available by Davey to me\/us\/the Customer, information about my\/our credit arrangements and credit eligibility for the purposes of the provision of commercial credit to me\/us AND\n
            \n
          • I\/We authorise Davey to obtain and use such personal information about me\/us\/the Customer in accordance with the Privacy Act 1988 (Cth) (as amended) and acknowledge that the authorisations contained in this document will continue to remain in full force and effect until payment of all amounts due by the Customer to Davey, AND<\/li>\n<\/ul>\n<\/li>\n
          • I\/We understand that the information referred to in clauses 8 and 9 may include any information about my\/our\/the Customer\u2019s credit worthiness, credit standing, credit history or credit capacity, defaults and repayments in respect of credit arrangements that credit providers are allowed to give or receive from each other under the Privacy Act 1988 (Cth).\n
              \n
            • I\/We have read the policy on credit reporting information of Davey available at Davey\u2019s Privacy Policy and acknowledge that this policy contains information about:<\/li>\n
            • How I\/we may access credit information about me\/us that is held by Davey;<\/li>\n
            • How I\/we may seek the correction of credit information or credit eligibility information about me\/us that is held by Davey;<\/li>\n
            • How I\/we may complain about the failure of Davey to comply with the Privacy Act 1988 (Cth) or the registered Credit Reporting Code (if this binds Davey);<\/li>\n
            • How Davey will deal with such a complaint; and<\/li>\n
            • Whether Davey is likely to disclose credit information to entities that do not have an Australian<\/li>\n<\/ul>\n<\/li>\n
            • I\/we also acknowledge that I\/we are aware that:\n
                \n
              • a credit reporting body may include information I\/we are authorised to provide them pursuant to this application in reports provided to credit providers to assist them to assess my\/our credit worthiness;<\/li>\n
              • I\/we are entitled to request a credit reporting body not to use our credit reporting information for the purposes of pre- screening of direct marketing by a credit provider; and<\/li>\n
              • I\/we are entitled to request a credit reporting body not to use or disclose credit reporting information about me\/us, if I\/we believe on reasonable grounds that I\/we has been, or is likely to be, a victim of<\/li>\n<\/ul>\n<\/li>\n
              • Declare that the above information is true and<\/li>\n
              • TAKE NOTICE that by signing this instrument you are accepting for all trading purposes the terms of this agreement and the Terms and Conditions of Sale (attached), and by signing this agreement you have acknowledged receiving a copy of each of this agreement and the Terms and Conditions of Sale and by your signature hereon have accepted them as binding upon<\/li>\n
              • As a result of you filling in this credit application, Davey Water Products Pty Ltd is collecting your personal Davey Water Products Pty Ltd promises only to use this information in accordance with the Provisions of the Privacy Act 1988 (Cth) and the Privacy Policy of Davey Products Pty Ltd which is available at daveywater.com<\/li>\n<\/ol>\n<\/div><\/div><\/div><\/div><\/div>
